This book was released on 2001-11-22 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: The First Amendment and Civil Liability Robert M. O'Neil A well-known First Amendment advocate explains the new threats to free expression posed by damage suits. This book explores a highly contentious set of issues involving freedom of speech and press. Until very recently, publishers and producers have assumed that, with a few exceptions like libel, freedom of expression was absolute and safe from civil liability in the form of damage awards. In the late 1990s, these complacent assumptions were sharply challenged. The case of the Hit-Man Manual signaled the shift. After a hired assassin had been convicted of a brutal murder in a Washington, D.C. suburb, it turned out he had used a book that contained graphic, detailed instructions on how to carry out an execution. When the family of the victims sued the publisher for wrongful death, a federal appeals court ruled that the book was "not protected speech" since its apparent purpose was "to facilitate murder." The publisher was thus, for the first time, potentially liable for criminal acts committed by a reader of one of its books. Later cases, especially a suit against Natural Born Killers' producer Oliver Stone, have invoked this ruling in seeking to impose liability on those who create and distribute material that causes others to inflict injury or death. Noted First Amendment scholar Robert M. O'Neil looks at seven areas where free expression is now at risk of incurring civil liability -- libel and slander (including a separate analysis of libel on the Internet), privacy (paparazzi and others who intrude), defective or dangerous "products," incitement (the claim of a link between speech and criminal acts, as in the Natural Born Killers case), advertising, news-gathering (for example, the Food Lion/ABC Primetime Live case,) and threats and incitement on the Internet (as in the anti-abortion Nuremberg website case.) O'Neil's clear exposition and analysis illuminate the issues for a broad range of readers concerned about a host of new threats to, and the limits of, free expression.

Download Love to Hate PDF Full or another Format written by Jody Roy and published by Columbia University Press. This book was released on 2002-08-27 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why? is the simple, impulsive question we ask when confronted by horrible acts of hatred and violence. Why do students shoot fellow students or employees their coworkers? Why do mothers drown their children or husbands stalk and kill their wives? Love to Hate challenges us to turn this question upon ourselves at a deeper level. Why, as a culture, are we so fascinated by these acts? Why do we bestow celebrity on the perpetrators, while allowing the victims to fade into a second death of obscurity? Are we, as Pope John Paul II famously accused, "a culture of death"? And if so, how can we break free of this unacknowledged aspect of the cycle of violence? Unlike those who point solely to media imagery, splintered families, or lax gun control laws in search of the roots of America's endemic violence, Jody M. Roy suggests that we all must be held responsible. She argues that we reveal our love affair with hatred and violence in the ways we think and speak in our daily lives and in our popular culture. The very words we use function as building blocks of callousness and contempt, betraying our immersion in subtexts of violence and hatred. These subtexts are further revealed in our complex attitudes toward street gangs, school shooters, serial killers, and hate groups and the paroxysms of violence they unleash. As spectators, driven by our impulse to watch, we become an integral part of the equation of violence. In the book's final section, "Freeing Ourselves of Our Obsession with Hatred and Violence," Roy offers practical steps we can take—as parents, consumers, and voters—to free ourselves from linguistic and cultural complicity and to help create in America a culture of life.

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on New York City-based actors and comedians who are self-acknowledged heroin users. Barry Spunt examines a number of hypotheses about the reasons why actors and comedians use heroin as well as the impact of heroin on performance, creativity, and career trajectory. A primary concern of the book is the role that subculture and identity play in helping us to understand the heroin use of these entertainers. Spunt captures the voices of actors and comedians through narrative accounts from a variety of secondary sources. He also examines how New York-based films about heroin relate to the major themes of his research.
